4Thought RV Pty Ltd (ABN 51 667 624 777) trading as LoadMate ("LoadMate", "we", "us" or "our") provides this Safety Disclaimer to help you understand the nature and limitations of the guidance provided through the LoadMate mobile applications, any related websites, any future web experience, and related features, content, exports and services (together, the "Service").
This Safety Disclaimer forms part of the legal framework for the Service and should be read together with our Terms of Use and Privacy Policy.
1. Purpose of LoadMate
LoadMate is a digital guidance and record-keeping tool designed to help you understand your towing setup. It helps you make informed decisions — it does not make those decisions for you.
The Service may present safety scores, confidence badges, compliance indicators, attention feed items, reminders, warnings, research outputs, simulations, snapshots, exports and related guidance. These features are designed to inform and assist, not to certify, approve or guarantee any outcome.
The Service is not a real-time driving, navigation or emergency safety system and should not be relied on as such.
2. Not Professional Advice
LoadMate is not a substitute for:
- professional mechanical assessment or inspection
- certified weighbridge verification of actual vehicle and trailer weights
- engineering certification or structural assessment
- legal compliance advice from a qualified professional
- manufacturer technical support, instructions or specifications
- any other professional advice, certification or assessment required for safe or lawful towing
If you have any doubt about the safety or legality of your towing setup, you should seek independent professional advice before towing.
3. User-Entered Data
The Service depends on information you provide or select, including vehicle specifications, trailer specifications, axle weights, tow ball mass, load weights, load positions, tyre information, service records, trip details and other inputs.
All calculations, scores, compliance indicators and guidance outputs depend on the data you enter. If your inputs are inaccurate, incomplete, estimated, outdated or based on assumptions, the Service outputs will reflect those limitations. LoadMate cannot independently verify the accuracy of user-entered information.
Some data used by the Service may be drawn from manufacturer materials, published standards, public sources, third-party datasets or system-generated assumptions. That data may contain omissions, errors, delays, regional differences or outdated information.
4. Safety Score
The Safety Score is a relative indicator based on published vehicle and trailer specifications, user-entered load and weight data, selected assumptions and scoring algorithms. It is designed to give you a general indication of how your entered data compares with published limits, selected assumptions and LoadMate's scoring criteria.
The Safety Score is NOT:
- a certified safety rating or certification
- a guarantee of roadworthiness, safety or suitability for towing
- a substitute for weighbridge measurement of actual vehicle and trailer weights
- an engineering, mechanical or structural assessment
- a guarantee of legal compliance in any jurisdiction
The Safety Score may not account for all factors affecting towing safety, including but not limited to road conditions, weather, driver experience, vehicle condition, vehicle age, vehicle modifications, aftermarket accessories, tyre condition, load securing, hitch condition, braking performance and other real-world variables.
5. Confidence Badge
The Confidence Badge indicates the quality and completeness of the data underlying your Safety Score. A higher confidence level means more of your data comes from verified or measured sources. A lower confidence level means your data includes more estimates, assumptions or gaps.
The Confidence Badge does not indicate safety. A high-confidence score based on accurate data may still indicate an unsafe or overloaded configuration. Confidence measures data quality, not towing safety.
6. Compliance Checks
The Service may compare user-entered weight values against published manufacturer specifications for Gross Vehicle Mass (GVM), Gross Combination Mass (GCM), Aggregate Trailer Mass (ATM), tow ball mass and related limits. Different regions may use different terminology for equivalent measurements (such as GVWR, MAM or similar).
These compliance checks indicate whether your entered values fall within published limits. They do not guarantee legal compliance. Legal requirements vary by jurisdiction and may include factors beyond weight limits, such as licensing, registration, braking requirements, lighting, load restraint, speed limits and other regulations that the Service does not assess.
7. Research Tool (Can I Tow It?)
The research tool provides indicative compatibility guidance based on published vehicle and trailer specifications. It is designed to help you explore whether a vehicle-trailer combination may be compatible in principle.
Research results are indicative only. They are based on published specifications and assumptions, not real-world measurements. They do not constitute legal, mechanical or engineering advice. They indicate theoretical compatibility, not guaranteed real-world performance.
Research results may not reflect real-world conditions, vehicle modifications, aftermarket accessories, actual loading, tyre specifications, hitch specifications, regional regulatory differences or current regulations in your area.
Always verify compatibility with the vehicle manufacturer, trailer manufacturer, a certified weighbridge and a qualified professional before making any purchasing, towing or compliance decision based on research results.
8. Compliance Snapshots and Exports
The Service may allow you to generate compliance snapshots, PDF exports, share cards or other exportable outputs. These are generated from user-entered data and published specifications.
Exported documents are guidance documents, not certified compliance assessments. They do not replace or substitute for professional assessment, official documentation or weighbridge verification. If you share an export with a third party, that third party should not rely on it as a certified or authoritative document.
You are responsible for verifying all weights at a certified weighbridge and confirming compliance through appropriate professional and regulatory channels.
9. Weight Distribution Hitch Guidance
The Service may provide guidance related to weight distribution hitch (WDH) setup, including suggested adjustments, load transfer indicators and related outputs. This guidance is based on user-entered data, published specifications and generalised engineering principles.
WDH guidance is indicative only. Correct WDH setup depends on your specific equipment, vehicle, trailer, load distribution and real-world conditions. Always follow the WDH manufacturer's installation and adjustment instructions, and seek professional assistance if you are unsure about correct setup.
10. Tyre Information
The Service may display tyre-related information including load index ratings, pressure guidance, age indicators and related data. This information is drawn from published standards, user-entered data and general reference tables.
Tyre guidance is informational only. It does not replace the tyre manufacturer's specifications, the vehicle manufacturer's placard or sticker, or professional tyre advice. Actual tyre performance depends on condition, age, wear, inflation, temperature, loading and other factors that the Service cannot assess.
11. Simulations and What-If Scenarios
The Service may include interactive simulations, what-if scenarios, load sliders or other exploratory tools that allow you to model different loading configurations or towing setups.
These tools are for exploration and education only. Simulated outcomes are based on simplified models, user-entered data and published specifications. They do not predict real-world performance, handling, safety or legal compliance.
12. Demo and Sample Data
Any demo, sample or illustrative data presented through the Service is provided for demonstration purposes only and must not be relied on as representing real-world vehicle, trailer or load specifications. If the Service displays scores, compliance indicators or research-style outputs using demo or sample data, those outputs are illustrative only and carry no safety, compliance or accuracy implications. Demo mode is addressed further in the Terms of Use.
13. Your Responsibility
You are solely responsible for:
- verifying your vehicle's and trailer's actual weights at a certified weighbridge
- ensuring your towing setup complies with all applicable laws, regulations and requirements in your jurisdiction
- following all manufacturer instructions, ratings, restrictions and maintenance schedules for your vehicle, trailer, hitch and related equipment
- seeking professional advice for any safety, compliance, engineering or legal concerns
- maintaining your vehicle, trailer, tyres, hitch and all related equipment to a safe and roadworthy standard
- exercising your own judgment before and during towing, regardless of any guidance provided by the Service
If there is any inconsistency between the Service and a physical measurement, manufacturer instruction, legal requirement or professional advice, you should rely on the verified real-world source and not on the Service.
14. Limitation of Liability
Our liability regarding your use of the Service is limited as set out in the LoadMate Terms of Use. To the extent that this Safety Disclaimer addresses safety-related matters also covered in the Terms of Use, both documents apply, and this Safety Disclaimer prevails on those matters if there is a direct conflict.
Nothing in this Safety Disclaimer excludes, restricts or modifies any consumer guarantee, statutory guarantee or other right that cannot lawfully be excluded, restricted or modified under applicable law, including under the Australian Consumer Law.
15. In-App Disclaimers
The Service displays contextual disclaimers at key points within the application, including on score breakdowns, compliance snapshots and research results. These in-app disclaimers form part of this Safety Disclaimer and reinforce the limitations described in this document.
16. Changes to This Safety Disclaimer
We may update this Safety Disclaimer from time to time.
The current version will be made available through the Service and at https://loadmate.io/safety-disclaimer. If we make material changes, we may notify users in-app, by email or by another reasonable method. Where appropriate, we may require renewed acknowledgement through the legal acceptance gate.
17. Relationship with Other Documents
This Safety Disclaimer should be read together with our Terms of Use (available at https://loadmate.io/terms) and our Privacy Policy (available at https://loadmate.io/privacy). Together, these documents form the complete legal framework for the Service.
To the extent that this Safety Disclaimer addresses a topic also covered in the Terms of Use, both documents apply.
18. Governing Law
This Safety Disclaimer is governed by the laws of Western Australia, Australia. Subject to any mandatory rights or local jurisdictional rules that apply to you and cannot lawfully be excluded, you submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.
